OFFICIAL CONTEST RULES
BY ENTERING AND PARTICIPATING IN THE CONTEST, ENTRANT (1) FULLY AND UNCONDITIONALLY AGREES TO ACCEPT AND BE BOUND BY THESE OFFICIAL CONTEST RULES AND BY ALL DECISIONS OF BLUEGRASS TODAY LLC, INC. (“BT”), WHICH DECISIONS, INCLUDING, WITHOUT LIMITATION, DECISIONS REGARDING ELIGIBILITY, WINNERS AND THE INTERPRETATION OF THE TERMS USED IN THESE OFFICIAL CONTEST RULES, SHALL BE FINAL AND BINDING IN ALL RESPECTS; AND (2) REPRESENTS AND WARRANTS THAT ALL INFORMATION PROVIDED BY ENTRANT IN CONNECTION WITH THIS CONTEST IS TRUE, ACCURATE AND COMPLETE AS OF THE DATE OF ENTRY.

This contest is open to any individual who is at the time of entry (a) a legal resident of one of the 50 United States or the District of Columbia (excluding Guam, Puerto Rico, and all other U.S. and foreign territories and possessions) (the “Eligibility Area”); and (b) 21 years of age or older. VOID OUTSIDE OF THE ELIGIBILITY AREA AND WHERE OTHERWISE TAXED, PROHIBITED OR RESTRICTED BY LAW. Employees of BT, its affiliates, agencies, sponsors, and members of the immediate families or households of such employees are not eligible.
LIMIT ONE ENTRY PER PERSON. Multiple entries by a single entrant are VOID. Prize is not redeemable for cash and is not transferable. No prize will be awarded for a winner who declines the prize. Void where prohibited or restricted. Prize must be claimed within 24 hours of official notification. Winner must be 21 years of age or older and, where permitted by law, will be required to sign and return a completed IRS W-9 form. All federal, state and local taxes on the prize are winner’s sole responsibility. By accepting the prize, winner waives the right to assert as a cost of winning said prize, any and all costs of redemption of said prize and any and all liability that might arise from redeeming or seeking said prize. Prize: Only one prize will be awarded – an iPad Mini with a retail value of $325 dollars (US). Winner will be selected at random. Maximum award per person/household is 1 prize. Winners are ineligible for additional prizes. The value of the prize set forth above represents BT’s good-faith determination of the maximum retail value thereof.

If signing up for the Daily Bluegrass Buzz newsletter, you may opt out immediately, or at anytime by emailing advertising@bluegrasstoday.com your email address with the word CANCEL in the subject line. Entries must be received by midnight July 22, 2013. All entries received after the end of the contest period will be discarded and deemed VOID. In the event of a dispute, entries will be deemed to have been submitted by the owner of the email account from which they were sent.
Winner will be determined in a random drawing from contest entries by BT, whose decisions will be final in all matters relating to this Contest. All entries become the property of BT. Odds of winning are determined by and depend upon the total number of eligible entries received. The use of robotic, automatic, macro, programmed or like methods (including without limitation the use of any promotion/contest subscription, notification, entry or like sites or service that offers contest entry services “on behalf of” entrant) is strictly prohibited. If you attempt to enter the contest in a manner other than as permitted in these Official Rules, then upon discovery thereof by BT, your entry will be deemed void and ineligible and you may be disqualified from further participation in the contest. Proof of entering contest online will not be deemed by BT to constitute proof of delivery or receipt of entry. No changes to any entry materials or information will be permitted once submitted.
Inability of BT to contact a potential winner, or return of emails or prize notification as “undeliverable” for any reason, may result in disqualification of such potential winner and selection of an alternate winner from among all remaining eligible entries. BT reserves the right in its sole discretion to substitute with either the cash value of the applicable prize that would otherwise have been awarded, or a prize or prizes of equal or greater value, in the event that (i) such prize is unavailable, or (ii) the winner is unable to receive, accept or assume responsibility for the prize for any reason.
BT is no responsible for late, lost, incomplete, stolen, ineligible or misdirected entries. Facsimiles or mechanical reproductions will not be accepted. BT assumes no responsibility for cancellation of the contest due to labor strike, terrorism, industry conditions, commercial viability, or any other cause beyond their reasonable control. No responsibility is assumed by BT for lost entries; incorrect or inaccurate online information relating to the contest (including typographical errors); any computer, telephone, cable, network, satellite, server, service provider, electronic, power, or Internet or other hardware or software malfunctions, failures, connections or availability; data loss or late or incorrect data processing; Internet traffic congestion; service provider/Internet/Site inaccessibility, unavailability or malfunction; garbled or jumbled transmissions; or unauthorized human intervention. Although BT and the Contest Entities attempt to ensure the integrity of the contest, BT is not responsible for the actions of entrants or other individuals in connection with the Contest, including entrants’ or other individuals’ attempts to circumvent these Official Rules or otherwise interfere with the administration, security, fairness, integrity or proper conduct of the Contest.
Without limiting any other provision of these Official Rules, BT reserves the right, at any time and in its sole discretion, to disqualify and/or deem ineligible to participate in this Contest, any individual it suspects: have compromised the integrity of the Contest or to have tampered with the entry process or the operation of the Contest; to have failed to agree to these Official Rules; to be in violation of these Official Rules; to be acting in bad faith, or in a non-sportsmanlike or disruptive manner; or to be annoying, abusing, threatening or harassing any other person in connection with the Contest.
Any attempt to damage the site or tamper with or undermine the legitimate operation of the contest is a violation of these official rules as well as criminal and civil laws. If BT believes or becomes aware that such an attempt has been, is being or will be made, BT reserves the right to seek remedies and damages from any responsible entrant(s) and other responsible individual(s) to the fullest extent permitted by law, including, without limitation, criminal prosecution.
By entering the contest, entrant agrees to defend, indemnify and hold BT harmless from and against any and all losses, damages, rights, claims, and actions of any kind arising in whole or in part, directly or indirectly, from the contest or participation in any contest-related activity, or resulting directly or indirectly from acceptance, possession, use or misuse of any prize awarded in connection with the contest, including without limitation personal injury, death and/or property damage, as well as claims based on publicity rights, defamation and/or invasion of privacy. Entrant also acknowledges they have read the BT Privacy Policy posted on Company’s website and accept the terms set forth therein.
BT controls and operates this contest from our office in the United States of America. The substantive laws (as distinguished from the choice of law rules) of the State of Tennessee and the United States of America applicable to contracts made and performed entirely in Tennessee and where the relevant contacts are with such state shall govern (i) the validity and interpretation of these official rules; (ii) the performance by entrant and the BT of their respective obligations hereunder; and (iii) all other causes of action (whether sounding in contract or in tort) arising out of or relating to the contest.
BT makes no warranties, and hereby disclaim and and all warranties, express or implied, concerning any prize furnished or made available in connection with the contest. In no event will BT be responsible or liable for any damages or losses of any kind, including without limitation direct, indirect, incidental, consequential or punitive damages, arising out of any access to and/or use of the web site, or the acceptance, possession, use, or misuse or, or any harm resulting from the acceptance, possession, use or misuse of, or participation in, any prize awarded in connection with the contest.
Any action against BT in connection with or related to this contest must be bought within one (1) year after the cause of action arises. The failure of BT to exercise or enforce any right or provision of these Official Rules shall not constitute a waiver of such right or provision. If any provision contained in these Official Rules is found by a court of competent jurisdiction to be unlawful, invalid, or for any reason unenforceable, the parties nevertheless agree that portion shall be construed consistent with applicable law as nearly as possible to reflect the original intention of BT, and that provision of these Official Rules shall be deemed severable from these terms and shall not affect the validity and enforceability of any remaining provisions.
